Welcome to WhichDayz! These Terms and Conditions ("Terms") govern your use of the WhichDayz mobile application and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using WhichDayz, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Eligibility

You must be at least 13 years old to use WhichDayz. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

4. User Types

Customers: Users who discover staff members, view schedules, send appreciation notes, and favorite their preferred service professionals.

Staff: Service professionals who create profiles, manage their work schedules, receive notes from customers, and connect with their audience.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Harass, abuse, or harm other users
• Post false, misleading, or defamatory content
• Impersonate any person or entity
• Upload viruses, malware, or malicious code
• Attempt to gain unauthorized access to our systems
• Use automated systems to access the Service without permission
• Interfere with or disrupt the Service
• Collect user information without consent

6. User Content

You retain ownership of content you submit to WhichDayz. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

You are solely responsible for your content and represent that:

• You own or have rights to share the content
• Your content does not violate any third-party rights
• Your content complies with these Terms and applicable laws

7. Intellectual Property

The WhichDayz name, logo, and all related content, features, and functionality are owned by WhichDayz and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Privacy

Your use of WhichDayz is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We are not responsible for:

• The accuracy of information provided by users
• Interactions between users
• Any employment or business relationships formed through the Service

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHICHDAYZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless WhichDayz and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may delete your account at any time through the app settings.

We may modify these Terms at any time. We will notify users of significant changes. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

These Terms are governed by the laws of the jurisdiction in which WhichDayz operates, without regard to conflict of law principles.
